STATE OF
PARISH OF CADDO
INTERGOVERNMENTAL AGREEMENT AND/OR
COOPERATIVE
ENDEAVOR AGREEMENT
BETWEEN THE CITY OF
This Agreement,
effective January 1, 2007, is made and entered into on this ____ day of
______________________, 2007, by and between the City of Shreveport
(hereinafter sometimes referred to as the “City”), a political subdivision of
the State of Louisiana, represented herein by Cedric B. Glover, its Mayor, and
the Parish of Caddo (hereinafter sometimes referred to as the “Parish”), a
political subdivision of the State of Louisiana, represented herein by Woodrow
Wilson, Jr., its Administrator and Chief Executive Officer.
WITNESSETH
WHEREAS, Article
VII, Section 14(c) of the Constitution of the State of Louisiana provides that “for
a public purpose, the state and its political subdivisions . . . may engage in
cooperative endeavors with each other, with the United States or its agencies,
or with any public or private association, corporation, or individual”; and
WHEREAS, the
Legislature by Act 12 of the First Extraordinary Session of 2005 enacted Part
IV-B of Chapter 8 of Title 40 of the Louisiana Revised Statutes providing for
the mandatory adoption by Parishes and Municipalities of certain building
codes; and
WHEREAS, the Parish
desires to cooperate with the City in the implementation of these certain building codes
as hereinafter provided; and
WHEREAS, the public
purpose is described as the implementation of certain building codes required
to be in compliance with Act 12; and
WHEREAS, the City
agrees to provide the services necessary to be in compliance with Act 12
through inspections of all Parish buildings and issuance of building permits
and the Parish agrees to require all persons issued said permits to pay
directly to the City its required fees for such inspections.

consideration of the mutual covenants contained herein, the City of

understood and agreed by and between the parties to this Agreement that the City

understood that each party to this Agreement agrees to indemnify and hold the
other party harmless from or against any and all liability for injury, damage
or loss sustained by any person(s) arising from or related to this Agreement
which results from such indemnifying party’s fault or negligence.
It is further
understood that after the initial 12 months of this Agreement either party may
invoke cancellation of this Agreement for any reason by giving the other party
written notice at least 90 days in advance of the effective date of
cancellation.
The Parish is
responsible for enforcement of all building codes within the Parish. The City’s responsibilities under this
Agreement apply to inspection services only.
